Alternative conflict resolution - training for legal professions – 30 hours

Curriculum:

3-day session: Conflict and mediation (30 hours)

  • Definition of conflict and its analysis
  • Communication skills in solving conflicts
  • Mediation process
  • Charakteristics of conflicts in relevant contexts
  • Use of mediation in specific areas
  • Simulation of mediation situation with supervision
  • Specific issues related to mediation

Participants will become familiar with basic principles of mediation and practice basic communication skills needed in conflict resolution.
They will go through various contexts where mediation may be applied (mediation in business, family mediation, mediation in community, mediation in the majority-minority relations and in ethnic conflicts, etc.). Participants will practice how to adapt the mediation process to the specifics of a given conflict and its context.

1. Definition of conflict and its analysis

Theory (1+0)
Practice (exercises, interactive methods (0+1)
Theoretical background for conflict analysis (1+0)
Skills in analyzing conflicts (0+1)

2. Communication skills in conflict resolution

Theorecital background with practical training of skills in small groups (1+5)

3. Mediation and its phases (according to C. Moore)

Theoretical background combined with practical exercises of conducting individual mediation phases (1+4)
Analysis of suitability of mediation for a given conflict (1+0)

4. Simulation of mediation situations with supervision

Simulation and related feedback (2+8)

5. Specific issues related to mediation

Ethical aspects of mediation (1+1)
Difficult situations and clients (1+1)
